Abstract:Zaključna naloga govori o pravnih podlagah za opravljanje nalog slovenskih vojakov v operacijah kriznega odzivanja. Pogoste naloge, katere slovenski vojaki izvajajo na večini operacij, kjer je Slovenska vojska prisotna z enoto,so naloge na kontrolnih točkah, posledično pa preiskava vozil, oseb, terpo potrebi tudi pridržanje. To so naloge, katere pripadniki Slovenske vojske po zakonodaji ne smejo opravljati v Republiki Sloveniji, saj so v pristojnosti policije. Zaradi lažjega opravljanja takšnih nalog izven Republike Slovenije pripadnikov Slovenske vojske, so predstavljene vrste mirovnih operacij, pravne podlage za napotitev, ter priprava in izkušnje pripadnikov, ki so sodelovali pri opravljanju takšnih ali podobnih nalog na operacijah kriznega odzivanja. Pooblastila za opravljanje nalog se opredelijo v fazi priprave operacije in so končno določena v OPLANU, katerega priloga so tudi Pravila delovanja (rules of engagement - ROE). Med opravljanjem nalog je potrebno spoštovati mednarodno pravo, nacionalno pravo in pravo države gostiteljice. Postopki, ki opredeljujejo delo na kontrolni točki, so natančno opredeljeni in jih je potrebno dosledno izvajati, saj lahko opustitev le tega privede do incidenta, katerega posledice lahko predstavljajo kršitev Mednarodnega humanitarnega prava, ter posledično kazensko odgovornost storilcain poveljnika. Poveljniki, so dolžni poskrbeti za ustrezno strokovno usposobljenost vojakov pri opravljanju del na kontrolni točki, ter jih poučitio pravnih vidikih in posledicah morebitnih napakah ali nedoslednega opravljanja nalog.

Language:EnglishAbstract:The article is explaining legal backgrounds for Slovenian soldiers performing their duties on crises respond operations. Daily missions, preformed by Slovenian soldiers on crises respond operations are also duties on check point- performing vehicle checking, checking persons and if needed also detaining persons. These are procedures, which Slovenian soldiers are not legally allowed to perform in home country Slovenia, because that procedures are in police jurisdiction. For better performance of such missions over the Slovenian border, the article is presenting types of crises operations; legal backgrounds for deploying forces, preparation and experience of the personnel already deployed to crises respond operations. Jurisdictions for performing mission are set in preparation phase and are stated in OPLAN, which contains also appendix Rules of engagement - ROE. During the performance of mission we have to respect international law, national law and law of host nation. Procedures preformed on check point are explicatory described and have to be preformed exactly, because mistakes can lead into an incident, meaning the violation of international humanitarian law, and consequence of that means trial for performer and commander/leader as well. Commanders/leaders are responsible for proper training and skills of soldiers for performance of duties on check point and also have to explain them, what consequences could have if duties are not preformed in accordance with law and authorized procedures.
