Language: | English | Title: | The State Attorney's Office, representing the interests of the state before the courts and administrative authorities | Abstract: | In this paper we critically analyse the functioning of the State Attorney‘s Office, especially in the context of the role of the state lawyer and his independence in representation, which is very loosely defined and guided by the Law on the State Attorney. The role of the State Attorney‘s Office, representing state bodies, cannot be equated with the classic role of a lawyer, as it is a specific interest of the state and differs from other legal and physical entities. The author concludes in the article that the role of the State Attorney‘s Office is not a power of attorney relationship with the state, but that the state has delegated its powers of representation to the State Attorney‘s Office. This means that the State Attorney‘s Office, while respecting its autonomy and independence, must absolutely act in the interests of the represented state entity, i.e. also in terms of representing the interests of the Ministry of Defence and the Slovenian Armed Forces. | Keywords: | State Attorney‘s Office, state lawyers, Ministry of Defence |
