Abstract:V prispevku kritično analiziramo delovanje Državnega odvetništva Republike Slovenije, še posebno v kontekstu vloge državnega odvetnika in njegove samostojnosti pri zastopanju, ki jo Zakon o državnem odvetništvu zelo ohlapno opredeljuje in usmerja. Državnega odvetništva, ki zastopa državne organe, ne moremo enačiti s klasično vlogo odvetnika, saj gre za interes države in se razlikuje od drugih pravnih in fizičnih subjektov. Avtor v prispevku ugotavlja, da pri vlogi državnega odvetništva ne gre za pooblastilno razmerje z državo, ampak da je država prenesla svoje pristojnosti zastopanja na državno odvetništvo. To pa pomeni, da mora državno odvetništvo ob upoštevanju avtonomnosti in samostojnosti absolutno delovati v interesu zastopanega državnega subjekta, torej tudi v smislu zastopanja interesov Ministrstva za obrambo in Slovenske vojske.

Language:EnglishTitle:The State Attorney's Office, representing the interests of the state before the courts and administrative authoritiesAbstract:In this paper we critically analyse the functioning of the State Attorney‘s Office, especially in the context of the role of the state lawyer and his independence in representation, which is very loosely defined and guided by the Law on the State Attorney. The role of the State Attorney‘s Office, representing state bodies, cannot be equated with the classic role of a lawyer, as it is a specific interest of the state and differs from other legal and physical entities. The author concludes in the article that the role of the State Attorney‘s Office is not a power of attorney relationship with the state, but that the state has delegated its powers of representation to the State Attorney‘s Office. This means that the State Attorney‘s Office, while respecting its autonomy and independence, must absolutely act in the interests of the represented state entity, i.e. also in terms of representing the interests of the Ministry of Defence and the Slovenian Armed Forces.Keywords:State Attorney‘s Office, state lawyers, Ministry of Defence
